BWB&O recently obtained a defense verdict in a premises liability case. Plaintiff was a day laborer who fell off of a roof, broke his left leg (compound fracture with the bone protruding from the skin) and right foot, both of which required surgical intervention including the placement of hardware. In addition to his left leg and right foot fractures Plaintiff also sustained a compression fracture to his back.
Plaintiff contended that BWB&O’s client was responsible for hiring Plaintiff and thus, owed a duty to Plaintiff to ensure that the job site was safe, including the supplying of Plaintiff fall protection which would have prevented his injuries.
Plaintiff sought over $1,000,000.00 during trial. After deliberating for less than 30 minutes, the jury returned a defense verdict in favor of the firms client.
